These Terms govern your use of the mobile applications published by Agapi Apps ("we", "us"). By downloading or using one of our applications you agree to them. If you do not agree, do not use the application. Not every section applies to every app; where a feature is not present in an app you are using, the section describing it does not apply to you.
These Terms do not replace Apple's licence agreement. Our applications are distributed through the Apple App Store, and your licence to use them is governed by Apple's own agreement. These Terms sit alongside it and cover the things it does not address.
Your licence to install and use our applications — including the scope of that licence, the applicable warranties, the limitations of Apple's and our liability, and Apple's role — is governed by Apple's Licensed Application End User License Agreement, available at apple.com/legal/internet-services/itunes/dev/stdeula/, together with the Usage Rules in the Apple Media Services Terms and Conditions.
These Terms apply in addition to that agreement and address matters it does not cover. If any provision of these Terms conflicts with Apple's Licensed Application End User License Agreement in respect of your licence to use an application, that agreement prevails.
Everything you import into, create with or produce using our applications remains yours. We claim no ownership of it and no licence to use it. Our applications process the documents and other content you provide locally on your device. We do not upload, receive, store or access the contents of those documents. You are responsible for having the right to use the content you process and for keeping your own backups of it.
You agree not to use our applications to break the law, to infringe anyone's intellectual property or privacy rights, to process content you have no right to process, or to interfere with the security or normal operation of the applications or the services they rely on.
This section applies only to applications that offer a subscription or in-app purchase.
Purchases are made through, and billed by, Apple's App Store, under Apple's terms. Prices, currency and applicable taxes are shown before you confirm. Subscriptions renew automatically at the end of each period unless cancelled at least 24 hours before the period ends, and your Apple Account is charged for renewal within the 24 hours before the current period ends. You can manage or cancel a subscription in the App Store settings on your device. Refund requests are processed by Apple in accordance with Apple's refund policies; we cannot issue refunds ourselves. Where a free trial is offered, any unused portion of it is forfeited when you purchase a subscription.
Paid features may change over time in accordance with applicable law. Where a change materially affects a paid feature, any rights or remedies available to you under applicable consumer law remain unaffected.
The applications themselves — their software, designs, graphics, text, icons and branding — remain the property of Agapi Apps or their respective owners, and are protected by copyright and other laws. Nothing in these Terms transfers any of those rights to you.
Our applications include open-source components licensed by their authors. Their licences are listed inside the applications that use them, and those licences govern those components.
Warranties and liability in respect of your licence to use an application obtained from the App Store are dealt with in Apple's Licensed Application End User License Agreement, and this section does not displace it. This section applies to everything else these Terms cover, and to any application you obtain other than through the App Store.
To that extent, our applications are provided "as is" and "as available", without warranties of any kind to the fullest extent permitted by law. We do not warrant that an application will be uninterrupted, error-free, or that it will produce a particular result. You are responsible for keeping copies of any content that matters to you before processing it.
To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, content, profits or goodwill, and our aggregate liability arising from or relating to an application will not exceed the amount you paid for that application during the twelve months preceding the event giving rise to the claim.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence, or for fraud. If you are a consumer, you keep the statutory rights your local law gives you, and these Terms do not affect them.
These Terms apply for as long as you use our applications. You may end them at any time by deleting the application. Termination of your licence itself is governed by Apple's agreement. Sections 2, 5, 7 and 10 survive termination.
We may update these Terms from time to time. The date at the top identifies the latest revision. Where required by applicable law, we will give reasonable notice of material changes. Changes do not affect rights that have already accrued, and your mandatory consumer rights remain unaffected. If you do not accept revised Terms, stop using the application.
These Terms are governed by the laws of the Republic of Cyprus. If you are a consumer, this choice of law does not deprive you of the mandatory protections of the law of the country in which you habitually reside, and nothing in these Terms affects your right to bring proceedings in the courts of that country, or our obligation to bring proceedings against you only there. Where you are not acting as a consumer, the courts of Limassol, Cyprus have exclusive jurisdiction over any dispute arising from these Terms. Apple's Licensed Application End User License Agreement carries its own governing law, which applies to the matters that agreement covers.
If any provision of these Terms is held unenforceable, the rest remain in force. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms; we may assign them in connection with a merger, acquisition or sale of assets. These Terms, together with the Privacy Policy and — for applications obtained from the App Store — Apple's Licensed Application End User License Agreement, are the entire agreement between you and us regarding our applications.
